Terms of service.

I, Client, agree to the following:

Retainer

An initial retainer and a signed contract must be secured prior to any services being performed by the Consultant.

Remaining balance will be PAID DIRECTLY TO PERFORMER in CASH at the end of the performance. Please do so away from children, if a character attendant is provided at your event, you may hand the cash to the attendant.

Contracted Package

Includes all services described in selected package details reviewed and distributed to clients. Any additional services/products requested by the client incurred by the consultant will be billed directly to the client at a cost. All services contracted cannot be deducted, but additional services can be added.

For your convenience, payments to the Consultant can be made through Party Pro Manager.

Expiration

Current event date is valid 1 week prior to services without a deposit being paid.

Provided Documentation

All documentation created and provided to the client is owned and copy written by the Consultant and cannot be used or given to any other 3rd party.

Destination

For all events deemed as destination (taking place beyond 25 miles from the performer’s home), additional fees are applicable.

Attire

All associates of the Consultant will wear proper character attire.

Liability

It is understood that the Consultant is only liable for services completed and provided by the Consultant and cannot be held liable for the services of other contracted vendors. It is understood that in no event shall the Consultant be liable for consequential damages of any kind.

Please understand many of our performers are arriving at your event from other scheduled events. Please be gracious with performers on arrival time, performers may be a few minutes delayed due to this, we ask that you be gracious and patient with us. If at any point a performer is going to be more than 10 minutes late, the character attendant or performer will alert the designated client with a notice via text message.

Cancellation Policy

If an event is canceled less than 24 hours before the event, no portion of the fees paid to the Consultant will be returned. If event is canceled prior to 72 hours before event date, remaining balances may be refunded to Client. Deposits are non-refundable.

If an event is postponed, all services will cease at the time of notification of postponement if no determined date is provided. Payment schedule will be determined and readjusted post-new event date notification. If the client requires services to resume, post new event date being established, second payment will be required at time of service re-start.

Responsibility

Consultant is not responsible for Acts Of God, Natural Disasters, an Act Of Government such as A Declaration of National or Local Emergency, or Other Incidents Not within the control of the consultant, i.e. accident, death in the family, illness, pregnancy, or sudden tragic circumstance. In such a situation, consultant will obtain, upon approval of the client, a qualified professional replacement to fulfill consultant’s obligations under the contract, at no additional charge to the client.

Our performers will plan ahead and take every precaution to be punctual, but due to the unpredictability of traffic and circumstances beyond their control, may arrive after their scheduled start time. Your performer will communicate with you, so please have your phone on and accessible. They will of course, stay for the entire length of booked time, regardless of arrival time.

If services are not satisfactory, please let the owner, Helaina White, know within 72 hours so any situation may be remedied. If concerns of unsatisfactory services are not brought to the attention of the owner after 72 hours have passed since the end of the event time, the owner is not obligated to refund or offer free, discounted, or otherwise gift/certificates to the client in regards to unsatisfactory services. We agree to do our very best to always accommodate special requests, and provide satisfactory services to the best of our ability.

Overtime

Additional unplanned and/or un-contracted services (such as, but not limited to day of event extension of time, services outside of the scope of agreement) are considered overtime and will be billed with prior notification and consent at the rate of $100 per hour for performers.

Costs

Any purchased items on behalf of the client for day of event that were not agreed upon beforehand will be billed directly to client at the cost of goods and mileage at $.66 per mile if extensive travel (beyond 25 miles) is required to be acquired.

Damage or Loss of Accessories

Client agrees to exercise all due care in caring for and preserving the property of Consultant. Clients shall remain responsible for all loss or damage to rentals, up to and including actual replacement value for each missing or damaged item per cost if damage is effect of Client.

Payment Schedule and Method

A deposit is due upon completion of the signed agreement for services. The remaining balance is due to the character attendant or performer in CASH by the end of the performance, away from children.

Attorney

If legal action is necessary to enforce the terms of this contract the prevailing party shall be entitled to reasonable attorney fees in addition to any other remedies to which that party might be legally entitled.

Appropriate Conduct/ Safe Working Environment

The Client(s) expressly agree(s) to take the best efforts to provide [Provider] and Provider's staff with safe and appropriate working conditions. In the event of circumstances deemed by either [Provider] or a bystander to present a threat or implied threat of injury or harm to [Provider] staff or equipment, the [Provider] reserves the right to cancel all services remaining under this Agreement and leave the event. If the [Provider] leaves the event early due to any offending behavior, the Client(s) expressly agree to relieve and hold [Provider] harmless as a result of incomplete event coverage, or for a lapse in the quality of the [Provider] work, and the Client(s) shall be responsible for payment in full.
